Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you (“User”) and Petshot Pro, a sole‑proprietorship owned by Preetam Nath, Indiagoverning your access to petportraitgenerator.ai and related applications (collectively, the “Service”). By accessing or using the Service you agree to these Terms and our Privacy Policy.

Petshot Pro may transfer or novate these Terms to an incorporated affiliate once formed.

1. Definitions

User Content: photos, prompts or other materials you upload.
Generated Images: AI‑generated images we deliver to you.
Sub‑Processors: third‑party vendors listed on our Sub‑Processors page.
Merchant of Record: Dodo Payments, which processes all paid transactions on our behalf.

2. Service Overview

Petshot Pro lets you upload pet photographs, which are sent to Replicate’s generative‑AI API to create stylistic pet portraits. Uploads and outputs are stored on Cloudflare R2 and delivered via our CDN. The platform is hosted on Vercel, uses a Neon Postgres database, and Auth JS for authentication.

3. Eligibility & Accounts

Age requirement. You must be at least 18 years old to use the Service. We do not permit registration by anyone under 18.
You agree to provide accurate information, maintain the security of your account, and promptly notify us of any breach.
One person → one account; shared or transferrable accounts are prohibited.

4. User Content & Intellectual‑Property Rights

Ownership: You retain all rights in User Content.
Licence to Petshot Pro: You grant us a worldwide, non‑exclusive licence to host, process, display and transmit User Content, and to generate, store and deliver Generated Images for Service operation. You may opt‑in separately if you’d like your uploads used for future model‑training.
Generated Images: To the extent we own or control any rights, we hereby assign to you all our right, title and interest in the Generated Images. You acknowledge that your use of Generated Images must comply with the policies of our AI sub‑processor (currently Replicate), and we make no representations or warranties regarding third‑party intellectual‑property claims. We retain a non‑exclusive licence to store copies for debugging, abuse‑detection and legal compliance.

5. Acceptable‑Use Policy

No illegal, defamatory, pornographic, hateful, or child‑exploitive content.
No infringement of intellectual‑property or privacy rights.
No scraping, reverse‑engineering, or overloading of infrastructure.
No unlawful, deceptive, or discriminatory use of Generated Images.
No uploading viruses, malware, or other code intended to harm or disrupt the Service.
Any other conduct that we, in our sole discretion, deem harmful, abusive or disruptive to the Service or its users.

6. Copyright Policy

We respect intellectual‑property rights. If you believe that content on the Service infringes your copyright, please email support@petportraitgenerator.ai with the subject line “DMCA Notice” and provide: (i) your physical or electronic signature; (ii) identification of the copyrighted work; (iii) identification of the infringing material (URL); (iv) your contact details; (v) a statement of good‑faith belief that the use is unauthorised; and (vi) a statement, under penalty of perjury, that your notice is accurate and you are authorised to act. We may remove or disable access to the contested content and terminate repeat infringers.

7. Fees, Payments & Refunds

Prices are shown at checkout and may include applicable taxes.
Dodo Payments is the Merchant of Record and processes all payments.
Refunds: If no downloadable portrait is delivered, or quality is materially defective, request a refund within 14 days of purchase. Refunds are at our reasonable discretion.

8. Modifications, Availability & Termination

We may modify features, pricing or these Terms with reasonable notice (email or in‑app). We may, in our sole discretion, suspend or terminate your access to the Service or your account at any time and without notice for any reason, including but not limited to non‑payment of fees, breach of the Acceptable‑Use Policy, or other legal or operational reasons.

9. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. You understand that AI‑generated content is probabilistic and may contain errors, artifacts or material you find objectionable; we expressly disclaim liability arising from the content or quality of the Generated Images.

We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non‑infringement.

We do not guarantee uninterrupted operation or that Generated Images meet your expectations.

10. Limitation of Liability

To the fullest extent permitted by law, Petshot Pro (including its owner, directors, employees and suppliers) shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or reputation, arising out of or related to the Service—even if we have been advised of the possibility of such damages.

Aggregate cap. In no event will our total cumulative liability (whether in contract, tort or otherwise—including for any security incident or data breach) exceed the total amount you actually paid to Petshot Pro for the Service in the twelve (12) months immediately preceding the event giving rise to the claim. If you have not paid any fees, our liability shall not exceed one hundred U.S. dollars (USD $100) or the equivalent in Indian rupees.

11. Indemnification

You agree to indemnify, defend, and hold harmless Petshot Pro and its owner from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to (i) your User Content; (ii) your use or misuse of the Generated Images; (iii) your breach of these Terms or any applicable law; or (iv) your violation of any third‑party right.

12. Governing Law & Dispute Resolution

These Terms are governed by Indian law. In the event of a dispute, the parties will first attempt to negotiate a resolution in good faith. If negotiations fail, the dispute shall be settled by binding arbitration seated in Dharamshala, Himachal Pradesh under the Arbitration & Conciliation Act 1996. Arbitration will be conducted in English by a single arbitrator appointed under the rules of the Indian Council of Arbitration, and each party will bear its own costs. You waive any right to participate in a class‑action lawsuit or class‑wide arbitration.

13. Feedback

If you choose to submit comments, ideas or suggestions about the Service (“Feedback”), you agree that we may use, disclose, reproduce, licence, distribute and exploit the Feedback without restriction or compensation to you.

14. Miscellaneous

You may not assign or transfer these Terms without our written consent.
Petshot Pro may assign or transfer its rights and obligations under these Terms to an affiliated company or successor in interest.
We’re not liable for force‑majeure events beyond our control.
Links to third‑party sites are provided “as is”; we are not responsible for their content or practices.
If any clause is unenforceable, the rest remains in effect.
Sections 4‒13 (including Disclaimers, Limitation of Liability and Feedback) survive termination.
